COMMERCIAL TOURISM LAW - 1

Commercial Tourism Law is a core teaching activity of the Master's Degree Programme in Intercultural Development of Tourism Systems.
The course will provide students with the basic principles of Tourism Law, their functions as regulatory tools of the tourism market and consumer protection.
To reach this scope, it is necessary to acquire adequate technical and juridical language and the ability to find solutions in the complexity of the sources of law, in particular with respect to the law of contracts which characterise this specific system.

1. Knowledge and understanding
1.1 Understand the multilevel legal system which governs the tourism area.
1.2 Understand the legal institutions and contracts most used in tourism activities. Knowledge of the elements characterising the tourism enterprises and professionals.
1.3 Understand the role of the studied legal institutions, how they govern the relationships between legal subjects and how find the best solution to solve disputes in Business to Consumer contracts.

2. Applying knowledge and understanding
2.1 Ability to comprehend the legal system and the sources of law applicable to a certain situation.
2.2 Ability to find the legal provisions and contracts suitable for a certain situation regarding different economic actors of the tourism sector.
2.3 Once acquired the knowledge of the legal institutions, determine which one finds application to solve conflicts or regulate a certain legal relationship (both economic and personal).

3. Making judgements
3.1 Capacity to understand legal provisions.
3.2 Ability to identify, distinguish, relate different principles and legal provisions belonging to different sources of the multilevel system.
3.3 Ability to find the provisions or the institutions to solve or manage private relationships.

4. Communication skills
4.1 Proper reporting of the specific features of private law, by using appropriate language.
4.2 Ability to interact with tourism law issues.
4.3 Ability to develop critical opinions.

It is recommended the study of the (Italian) Civil Code, including the Constitution, EU Treaties, and sectoral codes, such as:

- Codice civile, a cura di Adolfo Di Majo, Milano, Giuffré, last edition

The course is divided into two parts (6 ECTS for each part). The final mark will be the result of the average of the marks obtained in each part of the course.

At the end of the first part of the course (3° period), there will be the opportunity to take part in a written examination (duration: 2h max.) for students who have attended regularly most part of the lectures (11/15 lessons). Attendance to the lectures will be assessed by written signatures which will be collected. The written exam consists of four open questions regarding the subjects of the first part of the course.
If the student accepts the mark obtained in the written exam, the second part of the exam will be taken during the other exam session, until January 2025 session included. Thus, it will be possible to register the final mark obtained only after having successfully passed both exams.

Apart from the written examination at the end of the first part of the course, the exam will be oral, and the student will have the possibility to take separate exams for each part of the course, also in different ordinary exam sessions, without the necessity to take the first exam primarily.

The course is mainly structured into several frontal lessons. Possibly seminars will be also organised during the course.
