The course represents one of the basic teaching activities of the degree course and it will provide students with the foundations of Tourism Law, especially with respect to their functions to serve as market regulatory tools, by considering also the outcomes of the "e-tourism" revolution and the diffusion of ICT tools. In this sense, the analysis will cover the impact on the tourism sector of digitalisation, as well as the emerging phenomena of sharing economy, digital platforms and data flow.
To this end, it is essential to acquire an adequate technical and juridical background and the ability to find solutions in the complexity of the e-tourism sector, in particular with respect to the law of contracts which characterise this special system (e.g. tourist rental agreement, digital platforms, OTA, unfair commercial practices, etc.). A further and complementary objective of the course is to provide students with a basic knowledge of data protection, especially from the EU perspective (GDPR).
1. Knowledge and understanding
1.1 Understand the multilevel legal system which governs also the e-tourism sector, especially from an EU perspective.
1.2 Understand the legal institutions and contracts most used in tourism activities in the digital environment, how they govern the relationships between legal subjects and how to find the best solution to solve disputes, especially in asymmetrical relationships.
1.3 Understand the connection between data protection, the fundamental rights of individuals and the proper functioning of digital markets.

2. Applying knowledge and understanding
2.1 Ability to comprehend the legal system and the applicable sources of law.
2.2 Ability to find the legal provisions and contracts suitable for a certain situation regarding different economic actors of the tourism sector.
2.3 Ability to find a connection between the fundamental right to data protection, market regulation and consumer protection.

3. Making judgements
3.1 Capacity to understand legal provisions.
3.2 Ability to identify, distinguish, and establish connections between different principles and rules provisions.
3.3 Ability to find the provisions or part of them to solve conflicts of interest.

4. Communication skills
4.1 Ability to report the specific features of e-tourism law and data protection law by using appropriate and technical language.
4.2 Ability to interact with legal issues arising from the digital environment.
4.3 Ability to develop critical opinions on legal questions.

It is essential to study EU legal acts (regulations, directives), case-law by the Court of Justice of the European Union and other EU documents.
Written exam with 3 open-ended questions (max. time 1h and 15 min.).

For those who will participate in the workgroup (up until +3 bonus points for the positive feedback to be added to the final grade), the student may choose 2 out of the 3 questions.

The grade is determined by:
- knowledge and understanding of the exam's questions (range 10 points);
- ability to analytically scrutinize the exam's questions (range 8 points)
- ability to identify and highlight connections between legal rules (range 6 points);
- linearity and logic of the written answers (range 6 points)
The course is mainly structured into several frontal lessons.

Workgroups will also be organized with students which determine up until +3 bonus points for the positive feedback to be added to the final grade.
