EUROPEAN PRIVATE LAW - 2

The course provides students with specific knowledge of some areas of private law influenced by the European integration. In particular, it will specifically address some of the institutions introduced in the module "European Private Law - 1": consumer contracts, with particular attention to online purchase contracts; fundamentals of industrial and intellectual property rights and contracts (mainly patent, design registration, trademark, copyright; licensing and assignment contracts).

Knowledge and understanding. Students will be able to:
1. understand what conflicts of interests occur in the realm of consumer contracts and IP laws and how the main European legal systems deal with them;
2. understand EU laws and their impact on national law and markets;
3. identify the reasons justifying different national approaches, including their socio-economic background, their legal traditions and their current policy choices, and pinpoint principles and notions peculiar to each legal system.
Applied knowledge and understanding. Students will be able to:
4. analyse and critically evaluate solutions offered by the main European legal systems within the areas of interest;
5. use the legal terminology in discussing issues related to the subjects mentioned above;
Judgement and approach. Students will be able to:
6. evaluate and analyse legal and economic issues within the area of European Private Law.

Students are required to attend first module of the course "European Private Law - 1".

The course intends to provide an introductory overview of Consumer Law, and in particular Consumer Contracts, and Intellectual Property laws by dealing with the basic issues of trademark, patent and copyright law as they interface information technology and the Net.
Here is a list of issues which will be dealt with during the lectures:

.Consumer contracts, competition and market: legal solutions of the EU legislators;
.Consumer contracts and in particular off-premises contracts;
.Consumer contracts, e-commerce platforms, marketplaces.
(B). Intellectual property rights: definitions in the global context;
. Sources of law; territoriality and conflict of laws;
. Trademarks: access requirements and infringement
. Patents: access requirements and infringement
. Design: access requirements and infringement
. Software protection between copyright and patent laws
. Copyright: access requirements; scope of protection; infringement
. Trends in the evolution of the IP systems: open access, open science

All the materials shall be available on line (slides and case law)

The students will be given sample tests in order to prepare for the written exam and one of the final lectures shall be dedicated to a mock exam.
The written exam shall be in written.

The lectures will be taught in class. Teaching language is English.
