INTERNATIONAL LAW FOR THE ARTS

This course is part of the degree programs in Arts management, and it is aimed at providing a basic knowledge of International law issues relating to the protection of cultural heritage.

1. Knowledge and ability to understand the basics of International law relating to the protection of cultural heritage and the related legal terminology;
2. Knowledge and ability to solve the main problems related to the protection of cultural heritage;
3. Ability to understand a normative text and ability to develop an opinion on topics debated during the course;
4. Ability to write reports concerning cases seemingly discussed before International Courts and Tribunals;
5. Ability to find and read the normative sources and case-law, also in the main websites.

Knowledge of the fundamental elements of public law and private law.

- Fundamental aspects of International law: the sources of international law; the legal subjects; Intra-State Application of International Law;
- The International cooperation in the field of cultural heritage protection; the role of UNESCO;
- The International conventions adopted within the context of UNESCO and the Council of Europe;
- Regional approaches to the protection of cultural heritage (in particular, the European approach);
- The protection of cultural heritage in the perspective of International human rights law;
- The protection of cultural heritage in the event of armed conflict;
- Private International law issues related to the protection of cultural heritage and the trade in cultural goods;
- Circulation and restitution of cultural goods.

For attending students:
The study material will be indicated in class and uploaded on moodle.

For non-attending students:
- the material that will be uploaded on moodle (especially for private International law aspects); and

Written exam lasting an hour and a half. Only those who successfully pass the written exam will be able to choose to take an oral integration (the mark obtained in the oral exam will average with that obtained in the written exam). The exam will cover the entire program.

For attending students the modalities will be discussed during the course.

Lectures, analysis of texts and reading of judgments. The whole programme will be delivered in class.
Students will be stimulated to debate on the most current issues concerning the protection of cultural heritage through seminars on practical cases.
