This course is part of the master degree programme in "Studi Transmediterranei: migrazione, cooperazione e sviluppo" (LM80). It aims at providing a basic knowledge of International and European migration law, a knowledge which is necessary for a critical understanding of migration-related issues.
General goals
1. Ability to understand the basics of International and European migration law;
2. Ability to critically analize the relevant legal frameworks applicable to the migration phenomenon;
3. Ability to critically analize the main legal problems related to the migration phenomenon;
4. Ability to communicate and discuss legal issues related the migration governance as well as ability to write reports on said topics.
Specific goals:
1. Ability to search for relevant legal sources (International, EU, and domestic judgments included);
2. Ability to understand and analise normative texts;
3. Ability to understand and analise International, EU, and domestic judgments.
Basic knowledge of Public Law, international Law and EU Law.
1. Introduction to international and EU Law;
2. Historical origins of the migratory phenomenon and recent trends in contemporary migratory phenomenon.
3. International migration law: customary rules; conventional regimes; the role of soft law.
4. EU migration law: movement of persons in the EU, the Dublin system, EU external borders;
5. The governance of migration flows and the role of international, EU and national courts.
6. Focus on specific topics:
6.1. Migrations and human rights;
6.2. International protection obligations;
6.3. Old and new legal categories: refugees; migrant workers; trafficked and smuggled migrants; environmental migrants;
6.4. Family migration and legal protection.

Written exam: two open questions and a case resolution.

Lectures and workshops.
Students will be stimulated to debate on the most current issues of International and European migration law through seminars on practical cases.

Office hours take place via Zoom on Monday from 3 pm to 4 pm. Students are kindly required to send an email in order to schedule an appointment.

Thesis supervision shall be asked in person during office hours. Only to students who have passed the exam with a grade equal to or greater than 26/30 will be supervised. The first draft of the thesis must be delivered to the teacher at least one month before the deadline for uploading the thesis.
