The course aims to complete the first Private Law cours, providing students with essential information concerning European contract law.
1. Knowledge and understandings
- Knowledge of the recent evolution of European private law;
- Knowledge of model contracts;
- reading and understanding european case law;
2. Ability to apply knowledge and understandings
- critical reading skills about the recent evolution of European private law;
- Ability to apply the acquired knowledge in the treatment of the most recurrent issues concerning contractual relationships between consumers and professionals.
3. Judgment
Basic skills in the undertanding and treatment of contract issues.
Passing written test and oral Private Law (6 CFU) examination is a necessary precondition.
The sources of European private law. Consumer contracts and consumer protection in the european perspective. Commercial contracts. Producer's liability. Market digital trasformation.

Students will have to study only the following parts:
Cap. II, Armonizzazione, uniformazione e unificazione (paragrafi da 1 a 5, no paragr. 6);
Cap. V, Le fonti;
Cap. VI, L'applicazione delle direttive;
Cap. VII, Le sentenze della Corte di Giustizia tra interpretazione e creazione;
Cap. X, I contratti del consumatore;
Cap. XI, Il mercato digitale;
Cap. XII, La responsabilità del produttore.
Written test and oral exmination. During the oral examination will be assessed the ability to expose the acquired knowledge using an appropriate legal language. It will be also assessed the ability to apply the acquired knowledge in the treatment of the most recurrent issues concerning contractual relationships between consumers and professionals.
For the purposes of awarding the grade in thirtieths, it will be taken account of the student's ability to critically analyse the rules of European private law and their transposition into national law. The assessment will be based in particular on the following criteria
- knowledge and understanding of the institutes and principles of the subject and ability to apply them to concrete cases (60%);
- proper use of technical-legal vocabulary (25%);
- ability to consult and interpret relevant sources (15%).
The Course is structured in several frontal lessons and practical exercises.
