EUROPEAN UNION LAW

This course aims at providing students with a basic knowledge of European Union law, for the purpose of understanding the dynamics taking place in the EU legal order and to be able to study, even independently, additional specific areas of EU Law. Some judgments of the Court of Justice of the European Union will also be examined and discussed in class.

Knowledge and understanding: Knowledge of the main notions and of the peculiar characteristics of European Union law.
Applying knowledge and understanding: Ability to apply the knowledge acquired in order to analyse and interpret EU law and the Court of Justice’s case law.
Making judgements: Acquisition of functional skills in order to critically examine the main current issues concerning the European Union and its relations with Member States.
Communication skills: ability to transmit the notions learned, through logical coherence and adequate legal language.

Students must fulfil the minimum credit requirements (ECTS) for the admission to the master's degree programme in Comparative International Relations. Therefore, students must possess at least 6 ECTS from the legal area (IUS). In particular, a basic knowledge of Constitutional and/or Public Law (IUS/08, IUS/09) and, in particular, of International Law (IUS/13) would be appropriate.

The course will deal, in particular, with the following topics:
- Origins and evolution of the European integration process;
- The European Union: Goals, Values and Principles;
- The Institutional Framework of the European Union;
- EU Competences;
- The Sources of EU law (Treaties and other Sources; Secondary EU Law);
- Judicial remedies;
- The relationships with Member States’ legal orders.

The textbook must be accompanied by consultation of the main sources of European Union law (in particular, the consolidated versions of the Treaty on European Union and the Treaty on the Functioning of the European Union), available at www.europa.eu.

Oral exam.

The exam lasts about twenty minutes and is aimed at ascertaining the knowledge acquired and the capacity for legal reasoning and connection between the topics addressed, as well as the acquisition of adequate legal language. The student will be asked three questions, so as to evaluate the knowledge of the various parts of the program. In order to pass the exam, a sufficient mark in the answer to each of the three questions is required.
