This course is part of the master degree programme in Lavoro, cittadinanza sociale, multiculturalità. It aims at providing a basic knowledge of Public International Law in the fields of Migrations and Human Rights.
1. Knowledge and ability to understand the basics of Public International Law in the fields of Migrations and Human Rights;
2. Knowledge and ability to solve the main problems of Public International Law in the fields of Migrations and Human Rights;
3. Ability to understand a normative text and ability to develop an opinion on topics debated during the course;
4. Ability to write reports concerning cases seemingly discussed before the International Courts and Tribunals;
5. Ability to find and read the normative sources and case-law even through the main websites.
A basic knowledge of both Public Law and International Law would be appropriate.
First Part: General Introduction and Fundamental Notions of International Law (three hours).
1. Actors, sources, enforcement and ascertainment of International Law.

Second Part. International Human Rights Law (twenty-one hours).
2. Historical Development of Human Rights. Legal Fundation of Theories about Human Rights.
3. Regionalism and Universalism in International Human Rights Law. Customary Norms Concerning International Human Rights Law. Human Rights Treaties.
4. United Nations and Human Rights.
5. European Human Rights System.
6. African, American and Arabic Human Rights Systems.
7. Main Human Rights Internationally Protected.
8. Human Rights, States and Non-State Actors. International Responsibility for Human Rights Violations.

Third Part. International Law of Migrations (six hours).
9. The non-refoulement Principle and Other Means of Asylum Seekers Protection in the United Nations System.
10. The non-refoulement Principle and Other Means of Asylum Seekers Protection in the Council of Europe System.

Attending students:
International Human Rights Law: colloquium consisting in two questions in ten minutes.
International Law of Migrations: analisys and discussion of materials supplied during the last six hours of the cours.

Non-Attending students:
International Human Rights Law: colloquium consisting in two questions in ten minutes.
International Law of Migrations: colloquium consisting in one question in five minutes.
Lectures, analysis of texts and reading of judgments. The whole programme will be delivered in class.
Students will be stimulated to debate.
Owing to the current pandemic emergency, it may happen that lectures will be delivered online. In this case, more detailed information will follow on Professor Pascale personal webpage.
