Tourism, Digital Technologies, and Legal Disputes: A Practical Guide

Abstract:
The system of dispute resolution that may arise in the context of tourism-related economic activities is certainly among the basic legal knowledge which is necessary to acquire an adequate professional profile in the hospitality sector. The legal framework for resolving disputes that may arise in the context of B2C (business to consumer) and C2C (consumer to consumer) relations is currently changing, due to the role of digital platforms therein, in particular in the context of the sharing economy. Thus, the workshop intends to offer an accessible toolkit to future hotel professionals and tourism experts to untangle the complicated landscape of legal disputes in the tourism and hospitality sector, with particular reference to the transformations brought about by the digital revolution (e.g. the treatment of big data, digital marketing, on the Internet and on social media, online travel agencies, platforms, such as airbnb or booking). The focus will be on collective disputes and on the so-called Alternative Dispute Resolution, especially on Online Dispute Resolution, which consists of the use of technology to facilitate dispute resolution. Practical cases will be presented and formulated, and students will be actively engaged during the workshop.
