The educational goal of the course is to provide students with an understanding of the importance of European Law in the regulation of relations between individuals. Students shall understand the path that led to the creation of what we now call the European Union and find out how many and what are the rules applicable to private-to-private relations in EU Member States fall into the scope of EU Law and actually are of European origin.
The students shall be able to comprehend the institutional framework of the EU system, with a specific sensitivity to the legal perspective. Law play and has always played a crucial role in the past and present evolution of the EU institutions, leading the original Economic Communities to what we now call the Union. The path turns out to be not so simple in recent times, and the student will understand some of the main reasons of the perplexities spinning around the very idea of maintaining the EU as is. The students shall be given the necessary theoretical and practical instruments to address the legal problems they will encounter during the second part of the course.
No prerequisite are required.
The course begins with an introduction to the foundation of the European Union and its institutions and the European Union's competence in relations to private law matters. The course then addresses the issue of harmonization and standardization of European Law and the projects for a possibile codification of European private law. It goes on to analyze the most significant measures of euopeo legislator in Member States' private law: from europe citizenship to family law, from ownership to the contract, and in particular consumer contracts, from the privacy of civil liability, to the right of competition and the rules on state aid.
All the materials shall be uploaded in the online platform moodle.unive.it and shall remain available on line during the entire duration of the course and subsequents exam periods.
The students will be given sample tests in order to prepare for the written exam and one of the final lectures shall be dedicated to a mock exam.
The finale exam shall be in written.
The lectures will be taught in class with projection of slides; additional materials will be available online to deepen the contents of the lectures.
