The course is aimed to give the student the awareness of the legal themes and problems connected with the information technologies they use every day and, at the same time, the impact of these technologies on the traditional day by day legal affairs. Fundamentals of IT Law aims to define how it is possible to ask for a legal protection when we use IT devices or suffer a prejudice due to their misuse or abuse.
In a digital world continuously changing dimensions, scopes, directions and means, the students shall be able to detect the legal framework staying behind the internet and the IT technologies. Law is changing itself, adapting its character to the digital scenario, where the traditional State based hard-law approach switches into a contractual based soft law regulation, but still with a need for strong legal instruments to combat abuses perpetrated through IT devices: counterfeiting IP rights, violations of fundamental rights such as privacy, self-determination, dignity, etc. The students will be able to understand the boundaries between the hard and soft law approach and comprehend the remarkable legal issues implied by the use of the most common digital instruments.
Basic knowledge of information technology devices and most common social media devices.
The course will give the students an overlook on the legal approaches to the digital world: what kind of goods and individuals are protected in the digital arena? How can the law provide for effective instrument to grant such a protection? Is technology somehow controllable by the law? Do we really need a legal regulation for the digital devices?
The course will show how the law regulates the use and exploitation of Information Technologies with particular reference to the following arguments:
The legal discipline of the internet / Digital contracts / E-commerce, digital money and the online sales / Protection of personal data in internet and in social media applications and devices / Cloud computing.
The course material will consist of case studies, journal articles and book chapters. All the materials will be made available on the online platform Moodle.
The student shall be assessed in their knowledge of the basic principles and rule on IT Law, and in their ability to use these information in concrete cases by solving practical problems, analyzing a legal case, reporting on judicial solutions to IT Law judgements
Interactive approach based on: slides, study cases, group work, creation of common resources online, online forum discussions, guest speakers in class/video conference
